Can my ex refuse visitation because I am behind on child support?

Failure to pay child support is not a reason to refuse rightful visitation.  However, it is very difficult to ask a court to award or enforce visitation in the best interest of the child when you have failed to act in the best interest of the child by refusing to pay child support.

If you cannot pay your child support due to an unexpected job loss or financial hardship, you can ask the court for a temporary reduction of your payments.  However, as soon as you are able to pay, you will have to pay back the reduction amount.  Just because you lost your job or you are having financial difficulty your child support obligation does not get excused.

How do I get visitation with my child, if I was never married to the mother?

To get visitation, you first must be a legal parent. Unmarried fathers will need to prove paternity.   If you have no proof you’re the father, you have no rights under the law.  You will need to establish that you are the father before you may exercise your legal rights of visitation.

Parents have a right to see and visit with their kids. For parents with physical and legal custody, exercising that right is generally automatic. For parents who don’t have physical custody, that right is set out in the law.

Child custody AND visitation decisions are guided by what serves “the best interest of the child.”

I have just been served with divorce papers, what do I do?

Choosing a female or male attorney as a matter of strategy….myth or fact?

Clients strategically select the gender of their lawyer based upon several beliefs related to such conflict, which are more likely than not…myths.

Many men believe that, if they hire a female attorney, the judge will better accept a harsh position presented through the voice of a woman – in other words, that their position as male spouses is softened through the voice of a woman.   Often a woman believes that, by hiring a male attorney, the male lawyer will be better able to stand up to her husband and to give her strength she believes she otherwise does not possess.   These beliefs are stereotypes and do not take into account the reality of the law.  Therefore, they are myths.

A client is best served by honestly sharing the details of his or her marriage with his or her attorney.  Therefore, one of the most important criteria in hiring a family law attorney is whether or not a client is comfortable being open and honest about some of the deepest and darkest secrets a person holds.
